In recent years private enforcement of competition law has become increasing popular. Benelux courts are a go-to for competition claims and our expectation is this will grow even more in the next few years. Our team is ready to assist.
Our Benelux competition litigation specialists have years of experience and in-depth knowledge of the full range of antitrust, substantive and procedural law. The team combines a thorough knowledge of national and European competition law and economics with extensive experience in mass claims and collective actions.
We advise and litigate before the administrative and civil courts throughout the Benelux, as well as the Court of Justice of the European Union in Luxembourg. The team is involved in leading antitrust damages proceedings, both in follow-on and stand-alone proceedings. We also have an in-depth grasp of European Union law, including the Digital Markets Act and Digital Services Act.
With its cross-border expertise the close-knit team is also uniquely situated to advise and litigate in cross-border claims. Where necessary the team also works closely with our Supreme Court Litigation team and is frequently involved in competition cassation proceedings.
Recent examples of competition litigation cases handled by our team concerned:
- Air cargo
- Schiphol tariffs
- luxury brands
- Health care
- Electronics
- Food
- Cathode ray tubes for computer and television monitors (CRT)
- Lifts and escalators
- Flour
- Foreign exchange (Forex)
- High voltage power cables
In these often complex matters, our team collaborates with leading economic experts, in-house legal departments, and foreign lawyers. We can form multi-jurisdictional teams with top firms outside the Benelux, delivering effective tailored strategies that take related litigation in other countries in consideration.
We are proud to have been nominated for ‘Litigation of the year in cartel defence work’.
