In December 2005, Advocate−General Léger of the European Court of Justice ("ECJ") expressed his opinion that the liberal Dutch practice regarding cross−border injunctions lacks a sufficient legal basis. [1] Of course, this is not the final say on this matter as the ECJ must still rule. However, theAdvocate−General's opinion may herald the end of an efficient instrument to counter pan−European infringement.
