Provider Ziggo is not obliged to block The Pirate Bay. That is what the Court of Appeal of The Hague judged today in the case between two internet providers and BREIN. NautaDutilh assisted Ziggo in this procedure.
The District Court previously ordered the internet providers to block access to the website The Pirate Bay in favour of op vordering van BREIN, a litigation vehicle representing the entertainment industry. The Court of Appeal held that the blocking measures are apparently being circumvented on a large scale. The measures are therefore not effective and violate the freedom of entrepreneurship.
