Last Thursday saw the appeal hearing in The Hague Court of Appeal in the dispute between the Internet service providers (ISPs) Ziggo and XS4ALL and BREIN, a foundation that safeguards the collective interests of the entertainment industry.

The dispute has attracted a great deal of public attention. BREIN wants Ziggo and XS4All to block access to “The Pirate Bay” (a file-sharing site on which people share music files, among other things). Similar proceedings are also taking place in almost all European countries.

John Allen and Emma de Groot represented Ziggo and argued that the filtering measures imposed in first instance contravene article 10 of the European Convention on Human Rights, not least because they have an insufficient legal basis and are also disproportionate. The ruling is expected on 17 December 2013.
