'Public interest sometimes supersedes competition'
Following the Netherlands Authority for Consumers & Markets (ACM) refusal to give the merger between PostNL and Sandd the green light, Arnout Koeman wrote an op-ed in Saturday's Financieele Dagblad. He argues that the deal is not off yet, because the Competition Act states that the ACM's refusal can be revoked for "serious reasons in the public interest that outweigh the expected restriction of competition." But why stop there, Arnout asks, because reasons of general interest - for example sustainability - can also play a role in anti-competitive agreements between companies.
