Reform of the Belgian Civil CodeNew Bill on the Law of Evidence: what does it mean for your business?
On 6 November 2018, a bill inserting a new book 8 on evidence in the revised Civil Code was brought before the House of Representatives (hereinafter the "Evidence Bill").
The bill forms part of the Belgian legislature's efforts to modernise the Civil Code, which dates back to the Napoleonic era (1804). The reform focuses on four fundamental areas of civil law: contract law, tort law, property law and the law of evidence. For the time being, only bills on property law and evidence have been drafted and submitted to the House of Representatives. This newsletter covers only the Evidence Bill; the property bill will be addressed in an upcoming newsletter.
