For the magazine Vastgoed Fiscaal & Civiel, Boris Andriessen from our Real Estate and Infrastructure team wrote an article about compensation of damages upon termination of a lease agreement.

In practice, landlords regularly submit a request to the court to terminate a lease agreement due to a default on the part of the tenant. If the default is attributable to the tenant, the landlord is, in principle, also entitled to compensation for the damages it suffers as a result of that termination. In this article Boris describes what landlords and tenants should take into account if such compensation is claimed. Read the whole article (in Dutch) in PDF.
