NautaDutilh acts as data controller under the General Data Protection Regulation ('GDPR') and relevant GDPR implementation Acts and the provisions of other applicable laws, regulations and rules.

What personal data do we collect about you?

The personal data we process may include:

  • Basic information, such as your name, title, position, the company you work for, your relationship to a person;
  • Contact details;
  • Data necessary for processing invoices;
  • Metrics of your visit on our website, such as used device-type and user-agent;
  • Data relating to your attendance of events and interests;
  • Personal data that we need for compliance purposes;
  • Personal data provided to us in the course of rendering services which may include special categories of data;
  • Any other personal data relating to you that you provide to us.

How do we obtain your personal data?

We obtain the personal data in the following situations:

  • When you provide us with your personal data, or when you interact with us directly (by e-mail, telephone or letter;
  • When you enter into an agreement with us);
  • When we monitor our technology tools and services, including visits of our website and the e-mails which are sent to and from NautaDutilh offices.
  • When we collect personal data from other sources, such as local counsel, counterparties, the Trade Register, the Land Registry, commercial databases or by using public sources.

For what purposes do we process your personal data?

  • To process and to respond to requests, enquiries or complaints received from you;
  • To onboard and execute our services and supporting processes and systems required;
  • To manage and administer our relationship with you;
  • To comply with regulatory and policy requirements;
  • To provide services requested by you;
  • To identify services you may be interested in;
  • To communicate with you about our services;
  • To provide and improve our website by generating statistics regarding the use of the website;
  • To monitor and analyse our business processes and systems;
  • To handle your job application or subscription to any of our recruitment services or events;
  • To establish, exercise or defend a legal claim and proceeding against NautaDutilh and its staff;
  • Business development activities.

On what basis do we use your personal data?

  • To conclude and perform a contract;
  • To comply with regulatory and policy requirements;
  • For a legitimate interest (e.g. managing and administering the relationship with clients and suppliers);
  • With your consent.

How long do we keep your personal data?

We will keep your personal data no longer than is necessary to achieve the purposes stated in this Privacy / Cookie Policy. Your personal data will be retained in accordance with our retention policy, which is available upon request to the Data Protection Officer using the contact details set out under the section "How you contact us" of this Privacy/Cookie policy. The retention period for each category of personal data is based on regulatory and policy requirements and the purpose for which the information is collected and used.

Who do we share your personal data with?

In connection with the provision of our services and supporting, dispute resolution and  regulatory systems and processes we may need to share your personal data with our international offices in Belgium, Luxembourg, the United Kingdom and the United States (New York)) . We may also need to allow our suppliers and sub-suppliers access to your personal data when they perform services on our behalf (mainly to maintain and support our ICT systems) and regulatory authorities, courts, tribunals, government agencies and law enforcement agencies for the purposes specified above. Any transfer of personal data outside the EU/EEA is made in line with applicable data protection laws. How do we protect your personal data?

NautaDutilh has taken appropriate technical and organisational measures to protect personal data against loss or against any form of unlawful processing. The information security is in the hands of our excellent internal ICT professionals and has been awarded with a number of external recognitions.

The latest version of the information policy of NautaDutilh is available upon request. A copy of the information security policy can be requested from the Data Protection Officer using the contact details set out under the section "How you contact us" of this Privacy/Cookie policy.

What  rights do you have regarding your personal data?

The GDPR and other applicable laws foresee in certain rights for data subjects under the conditions set out therein. You, as a data subject, specifically have the following rights:

  • Right to access your personal data;
  • Right to rectification or correction of your personal data;
  • Right to erasure of your personal data;
  • Right to object or to request restriction of processing of your personal data;
  • Right to data portability;
  • Right to object to profiling;
  • Right to lodge a complaint with a supervisory authority;
  • Right to withdraw your consent for the future to the extent that the processing of your personal data takes place on the basis of your consent.

Our website uses cookies. Cookies are small text files containing information that are placed on the user's computer when he/she visits a website.

Functional cookies

We use cookies that are necessary in order to communicate over the internet or in order to provide a requested service (functional cookies).

If you select a language in which you want to view the website (Dutch, English or French) we place a cookie to display the site in the language chosen. This cookie is stored on your computer for 1 year, so that you do not have to select the language again the next time you visit our website.

We also place functional cookies for the security of the website and the user. These are session cookies, which means that they are temporary and will be removed from your computer after you close the internet browser following your visit to the website.

In addition we use Google Analytics, a web analytics service provided by Google Inc. In this regard, our website will be analyzed in order to, for example, count the number of visitors to the site and see which pages are visited the most. This will enable us to improve our website and our services. Google Analytics uses cookies to carry out its analysis and for technical support. We have entered into a data processing agreement with them and have disabled the option to 'share data' with them for their own purposes. These cookies are (currently) stored for a period ranging from the duration of the session to 2 years. Data which are recorded include your IP address (from which the last 3 digits are removed), the number of pages visited, the time and duration of the visit, your location, the origin of the visit, the type of hardware and software used, interaction visitor and your search history. The data obtained will be transferred to Google and saved by Google on servers in the United States; a country which does not provide for a similar level of data protection as the European Union. AddThis cookies

On the website it is also possible to share certain pages and articles through various social media and applications. This occurs by means of an AddThis tool which uses cookies for this purpose. Such cookies are (currently) stored for a period ranging from the duration of the session to 2 years. We are not responsible and/or liable for the use of data by AddThis and/or other external parties.

When you first visit our website, it is explained that by continuing to use the website and clicking on the next page, or, closing the cookie notice, you give permission to place 'add this' cookies. We register your consent with a cookie. If you do not give permission you will still be able to visit our website, in which case the functional and google analytics cookies will be stored on your computer. If you select a language or decide to share articles/pages the relevant additional cookie(s) will also be placed. We will use a cookie to register whether or not you have given permission to place 'add this' cookies. This cookie is stored for 1 year. We also store your IP address, as well as the date and time on which you gave such permission.
