Does embedding constitute copyright infringement? CJEU provides guidance in BestWater

On 21 October 2014 the Court of Justice of the European Union ("CJEU") rendered an important decision regarding the embedded linking of copyright-protected works (C-348/13). The court order answers the question raised by the German Supreme Court (Bundesgerichtshof) whether, in short, embedding constitutes a "communication to the public".
