On Thursday 19 March 2020, NautaDutilh will organise its Competition law seminar focussed on the new Belgian prohibition of abuse of economic dependency.
This prohibition has been introduced with effect as of 1 June 2020 in the Belgian Economic Law Code. The prohibition entails that an undertaking may not abuse of the economic dependency of another undertaking where this affects competition on (part of) the Belgian market. The prohibition adds to the existing competition law instruments, i.e. anti-competitive agreements prohibition and abuse of dominance prohibition. The prohibition will without doubt impact your discussions with your business partners and may impact your agreements, and more particularly your distribution agreements. Our seminar will consist of an interactive panel discussion in which we provide you a brief update of the prohibition and the impact for your daily practice.
The Belgian prohibition on abuse of economic dependency mirrors similar prohibitions in France and Germany. In our interactive panel we will thus highlight the retour d'expérience from these two jurisdictions. We are delighted that Dr. Alexander Birnstiel, partner in the competition law department at Noerr, and Mrs. Laura Castex, counsel at Gide with a specific focus on this topic, agreed to share their experiences with us. Noerr and Gide are two leading law firms in, respectively, Germany and France.
Moreover, we are happy that we are also able to provide you a business perspective and are delighted that Mr. Walter Gelens, CEO of the Belgo-Luxembourg Brands Association BABM, will participate on our interactive panel.
