Kirsy Corten is a counsel in NautaDutilh's Dispute Resolution practice group. She advises and litigates on a broad range of matters, with a specific focus on the real estate, construction, energy and defence sectors.

Kirsy represents her clients in court litigation and international and domestic arbitration.

Kirsy has extensive experience in construction law and advises and represents employers and contractors in construction matters in the Netherlands and abroad involving national and international standard terms, such as UAV, UAV-GC, DNR, FIDIC, DBFM as well as custom-made contracts. She has experience with all aspects of construction and energy disputes including termination, suspension, delay, rights to payment, variations, defective works and liability claims.

In addition, she has specialist knowledge of contracting law, lease law and procurement law. She is a frequent contributor to leading legal journals on topics within her areas of expertise.

  • Work highlights

    • Representing a renewable energy company as employer in international arbitration proceedings (NAI Rules) against its construction contractor regarding various claims and counterclaims (including liquidated damages for delays, descoped works, variations, extension of time);
    • Advising a renewable energy company in a pre-arbitration dispute (ICC Rules) with its EPC contractor in respect of inter alia liquidated damages due to delays and descoped works;
    • Representing a global producer of essential materials in several legal proceedings regarding its leasehold right in the Port of Rotterdam, related to an alleged sale and purchase agreement and terminated negotiations, including the lifting of prejudgment attachments;
    • Advising a foreign listed company in a pre-arbitration dispute in relation to a sale and purchase agreement regarding plants in the Port of Rotterdam;
    • Advising a client in a pre-arbitration dispute (NAI Rules) with a global industrial gas company in relation to a loan-for-use agreement and a sublease agreement related to plots in the Port of Rotterdam;
    • Representing an international real estate company as employer in a dispute with its project developer under the DNR (De Nieuwe Regeling, the Dutch standard conditions for architects/engineers) in relation to a major development project;
    • Representing several clients in disputes regarding the interpretation and performance of various types of agreements in the real estate and energy sector;
    • Representing landlords and tenants in disputes concerning interpretation of lease terms, defects, end-of-lease inspections, rent arrears, termination and evictions;
    • Advising Neste with respect to all civil-law legal aspects of its Renewable Jet Fuel (RJF), Wastewater Treatment (WWT) and Rotterdam Capacity Growth projects in the Port of Rotterdam;
    • Representing the winning bidder in summary proceedings initiated by a rejected bidder challenging the Ministry of Defence's award decision for a EUR 4-6 billion military equipment acquisition;
    • Representing Pilatus Aircraft in summary proceedings initiated by a rejected bidder against the award decision of COMMIT (Ministry of Defence) for the acquisition of trainer aircraft and associated services. The project budget of the ministry of defence for the acquisition of eight trainer aircraft and associated services was in the range of EUR 100-250M;
    • Representing Broshuis in summary proceedings initiated by a rejected bidder against the award decision of COMMIT (Ministry of Defence) for the acquisition of trailers and semi-trailers.
  • Qualifications

    Kirsy obtained two master's degrees in Dutch law from Maastricht University (2015/2016). In 2021, Kirsy completed the postgraduate course on contracting law at the Grotius Academy (cum laude) and was selected as the 'Upcoming Talent of the Year 2021' in the annual election of Legal Women. Kirsy has been with NautaDutilh since 2023 and was previously a lawyer at an international law firm and a corporate lawyer at a hospitality company. She is admitted to the Amsterdam Bar Association.
