We have extensive knowledge and expertise in relation to pensions across a range of disciplines. We advise on developments in the pension sector in the area of governance, duty of care and communication, supervision, outsourcing, mergers and liquidations. Furthermore, we provide all relevant services in respect to dealing with the regulator. And handle disputes and litigate on all aspects of the above.
The many changes in the pension sector in the demographic, social and economic spheres, the renewal of the pension system and the increasing costs and associated regulatory burden do create major challenges. - Assisting the Central Works Council of Johnson & Johnson with the amendment of its pension scheme as a result of the new pension legislation.
- Assisting Lifetri's entrance into the Dutch pension market (2020)
NautaDutilh assisted Lifetri and its shareholder Sixth Street with Lifetri's entrance into the Dutch pension market and the takeover of part of the pension portfolio of Allianz. - Assisting DMFCO and Dutch pension funds with a platform for direct investments in mortgage loans. NautaDutilh acted as counsel to Dutch Mortgage Funding Company (DMFCO) that launched a platform which enables institutional investors to directly invest in Dutch residential mortgage loans.
- Representing ECN/NRG in fundamental arbitration proceedings and before the Dutch Supreme Court on the amendment of indexation policy vis à vis pensioners (2013).
- Representing the AFM in fundamental proceedings before (amongst others) the Dutch Supreme Court on the amendment of their pension scheme (2023).
- Assisting a Dutch financial services provider in major pension arbitration on the termination of administration agreement (2023).
