David van Ee

• Advising Neste with respect to all legal aspects of the Rotterdam expansion project, including drafting and negotiation the Engineering, Procurement & Construction Management (EPCM) agreement concluded with Technip Italy, the EPCM contractor, as well as the construction contracts to be entered into with construction contractors, discussions with construction contractors and any other legal support requested by Neste.
• Advising Neste Netherlands B.V. on all legal aspects of its Renewable Jet Fuel (RJF) and Wastewater Treatment (WWT) projects.
• Assisting the lenders as lenders legal advisor on all legal aspects of the design, build and maintenance of the Afsluitdijk in the Netherlands.
• Representing the winning bidder in the summary proceedings initiated by the reject bidder against the award decision of the ministry of defence for the acquisition of 8 trainer aircrafts and associated services. The project budget of the ministry of defence for the acquisition of eight trainer aircraft and associated services was in the range of EUR 100-250M.
• Representing the winning bidder in the summary proceedings initiated by the reject bidder against the award decision of the ministry of defence for the acquisition of 4 conventional submarines in the Orca-class. The project budget of the ministry of defence for the acquisition of four conventional submarines was in the range of EUR 4-6 billion.
• Representing the winning bidder in the summary proceedings initiated by the reject bidder against the award decision of the ministry of defence for the acquisition of 146 trailers and semi-trailers. The project budget of the ministry of defence for the acquisition of the trailers and semi-trailers was in the range of EUR 50-100M.
• Key projects include the new Eefde Lock, Redevelopment Rijnstraat 8 (VR8), PPP Dutch Supreme Court (PPS Nieuwbouw Hoge Raad der Nederlanden), Redevelopment of the Ministry of Finance's offices in The Hague (KV7), PPP N33 Assen-Zuidbroek, Hart van Zuid, as well as the refinancing of several PPP projects. David advises the municipality of Amsterdam on major development projects and ground lease (erfpacht).
• He advises and litigates on procurement and construction projects on behalf of contracting authorities, including the municipality of Amsterdam and Neste, and developers and contractors, such as Koninklijke BAM and Siemens Nederland.

David is a member of the UNECE Working Party on Public-Private Partnerships. Furthermore, David is a member of the Association of Construction Lawyers (VBR-A) and the Association for Procurement Law (NVvA). He publishes on his areas of specialisation in legal journals such as TBR, Vastgoed Fiscaal & Civiel and in the Financieele Dagblad.

David graduated from Leiden University in 2000 and joined NautaDutilh in the same year. He became a partner in 2011. He holds a postdoctoral economic degree in real estate finance and development (MRE).
