Sven Uiterwijk is partner in our Financial Law group. He advises financial institutions, such as banks, insurance companies, clearing houses, pension funds and investment funds on European, Dutch and Dutch Caribbean banking and securities law, with a focus on financial regulatory law and supervision, derivatives, recovery and resolution, collateral, clearing, securities lending, repos and prime brokerage.
Sven additionally focuses on various topics concerning AI, IT-risk management, and digital assets, including distributed ledger technology (DLT), tokenisation (including tokenised securities and deposits), stablecoins, central bank digital currency (CBDC), crypto-assets, and crypto-asset services.
A selection of the laws and regulations Sven advises on: AIFMD/UCITS, BRRD/SRM, CRD/CRR, DORA, EMIR, IFD/IFR, MiCAR, the DLT Pilot Regime, MiFID II/MiFIR, PSD II, SFTR, Solvency II and the Wft.
Sven regularly publishes on subjects relating to banking and securities law.

Some of Sven's recent work highlights include assisting:
- ABN AMRO Bank N.V. on the custody of tokenised securities and the safekeeping of the public/private keys giving access to these securities.
- ABN AMRO Clearing Bank on the launch of a new fractional investment infrastructure and partnership with fintech-broker BUX.
- ABN AMRO Clearing Bank on their blockchain-based alternative for escrow accounts, including their cooperation with ABN AMRO Bank on the launch of ID&Pay.
- de Volksbank on the acquisition of valuation platform Fitrex.
- de Volksbank on the issuance of subordinated Tier 2 green bonds.
- the Dutch Banking Association in connection with additional COVID-19 relief arrangement for small businesses (Garantie Klein Krediet Corona).
- Waard Leven on the acquisition of the insurance portfolio of Conservatrix.
- Woningborg on their envisaged cooperation with French insurer SMABTP.
Sven regularly provides legal opinions to industry associations (ISDA and ICMA/ISLA) and market participants on the enforceability of financial master agreements and financial securities in the Netherlands.

Qualifications
From March 2015 until February 2016, Sven worked at NautaDutilh's New York office where he advised clients on Dutch and Dutch Caribbean (Curacao, St. Maarten and Aruba) law aspects of US originated or US coordinated finance and capital market transactions.
Sven earned an LL.M. degree in both corporate law and civil law from Leiden University. Sven is admitted to the Amsterdam Bar.
